Public Offer
Terms of attending ŞAM performances and other events: tickets, admission, postponement, cancellation and refunds.

1. General provisions
1.1. This document is a public offer by Sham creative Company LLP, BIN 231140028994, address: 16 Shukshin Street, Medeu District, Almaty 050059, Republic of Kazakhstan (the “Organiser”, “ŞAM”), to conclude a contract for the paid provision of services for showing a public entertainment event (the “Contract”) with any individual (the “Spectator”) on the terms below (Article 395 of the Civil Code of the Republic of Kazakhstan).
1.2. The offer applies to events organised by ŞAM, as stated on the ticket or on the ticket sale page. If the organiser of an event is another person (for example, a local promoter on tour, or the venue), that organiser’s terms apply.
1.3. The offer is accepted by paying for a ticket from the Organiser, from a ticketing operator authorised by it, or at a venue box office (Article 396(3) of the Civil Code of the Republic of Kazakhstan). From the moment of payment, the Contract is concluded on the terms of the offer in the version in force on the date of payment. Attending an event with a ticket received from the buyer means the Spectator agrees to the terms of the offer.
1.4. The ticket confirms the conclusion of the Contract and the Spectator’s right to attend the event stated on it.
2. Definitions
- Event: a performance, screening, concert or other public entertainment event of the Organiser;
- Ticket: an electronic or paper document certifying the Spectator’s right to attend the Event in the stated seat;
- Ticketing operator: an organisation that sells tickets on the Organiser’s instructions on its website, in its app or at its box offices;
- Venue: a theatre, concert hall or other place where the Event is held.
3. Buying a ticket
3.1. Tickets are not sold on the Website. Sale links and the dates sales open are published on the Website in the Tickets section and on ŞAM’s social media.
3.2. The ticket price is shown in tenge at the point of sale. A ticketing operator may charge a service fee under its own rules.
3.3. How a ticket is paid for, received and passed on is determined by the rules of the ticketing operator or the venue box office.
3.4. The Organiser is not responsible for tickets bought from persons it has not authorised to sell tickets, and may refuse admission with a ticket that has already been used or has been declared invalid.
3.5. Every Spectator, including a child, needs their own ticket, unless stated otherwise at the point of sale.
4. Rights and obligations of the Organiser
4.1. The Organiser undertakes to hold the Event on the date, at the time and at the Venue stated on the ticket.
4.2. The Organiser announces the cancellation or postponement of an Event, or a change of Venue, on the Website, on ŞAM’s social media and through the ticketing operator.
4.3. The Organiser may replace performers and make changes to the Event that do not alter its essence. The running time of the Event is approximate.
5. Obligations of the Spectator
5.1. To respect the age rating of the Event. It is shown on the production page and at the point of sale; the Organiser and the Venue may ask for proof of age.
5.2. To arrive in advance, at least 15 minutes before the start. Once the Event has begun, entry to the hall is possible only at the administrator’s discretion and if it does not disturb the performance. Arriving late is not a ground for a refund or exchange.
5.3. To follow the Venue’s rules and ŞAM’s Theatre etiquette, and not to disturb the artists or other spectators.
5.4. Not to take photos or make video or audio recordings during the Event without the Organiser’s permission.
5.5. To keep the ticket until the end of the Event and not to share its code with others: admission is granted on the first ticket presented.
6. Cancellation, postponement and refunds
6.1. If an Event is cancelled, the Spectator is refunded the full price of the ticket.
6.2. If an Event is postponed, the ticket is valid for the new date. If the new date does not suit the Spectator, they may return the ticket and receive its full price.
6.3. Refunds in the cases set out in clauses 6.1 and 6.2 are made where the ticket was bought, through the ticketing operator or the venue box office, in the manner established by their rules and the legislation of the Republic of Kazakhstan. The service fee is refunded in accordance with the ticketing operator’s rules and the legislation of the Republic of Kazakhstan.
6.4. If the Event takes place as announced, a ticket is returned at the Spectator’s initiative under the rules of the point of sale and the consumer protection legislation of the Republic of Kazakhstan.
6.5. A change of performers or the changes described in clause 4.3 are not grounds for a refund.
7. Filming in the hall
7.1. The Organiser may photograph and film the Event for ŞAM’s archive, announcements and publications. A Spectator may appear in general shots of the hall. If a Spectator becomes the main subject of a shot, the Organiser asks for their consent.
8. Liability and force majeure
8.1. The parties are liable in accordance with the legislation of the Republic of Kazakhstan.
8.2. The parties are released from liability for failure to perform their obligations due to force majeure: natural disasters, decisions of public authorities, accidents at the Venue and other events the parties could not foresee or prevent. In that case the Event is postponed or cancelled under the rules of section 6.
8.3. The Organiser is not responsible for belongings left unattended. The cloakroom works under the Venue’s rules.
9. Personal data
9.1. The personal data of ticket buyers is processed by the ticketing operator under its own rules. If the Organiser receives information about buyers, for example to announce that an Event has been postponed, it processes that information under the Privacy Policy.
10. Claims and disputes
10.1. Claims are sent to info@shamstudios.kz. Disputes are settled by negotiation and, failing agreement, by a court in accordance with the legislation of the Republic of Kazakhstan, respecting the consumer’s right to choose the court.
11. Term and changes
11.1. The offer is valid from its publication on the Website until it is withdrawn. The Organiser may change the offer; a new version does not apply to tickets paid for before its publication.
