Consent to Personal Data Processing

1. Who gives consent and to whom

1.1. By ticking the consent box and sending the form on shamstudios.kz, I, the person who entered their name in the form (the “Data Subject”), freely, of my own will and in my own interest, give Sham creative Company LLP, BIN 231140028994, address: 16 Shukshin Street, Medeu District, Almaty 050059, Republic of Kazakhstan (the “Operator”), my consent to the collection and processing of my personal data on the terms below.

1.2. If I send the form on behalf of an organisation, I confirm that I am entitled to provide the Operator with the data given in the form.

1.3. The consent is given in accordance with the Law of the Republic of Kazakhstan No. 94-V of 21 May 2013 “On Personal Data and Their Protection” (the “Law”).

2. List of personal data

Name; phone or WhatsApp number; email address; organisation name; subject of the request and message text; page language, date and time the form was sent, browser details and a hash of the IP address.

3. Purposes of processing

• considering my request and replying to it;
• preparing, concluding and performing a contract on request;
• protecting the Website and the form against spam and abuse.

4. Actions with the data

Collection and processing: accumulation, storage, modification, supplementation, use, depersonalisation, blocking and destruction.

5. Transfer to third parties

The Operator may transfer my data to third parties to the extent necessary for the purposes of processing: to the hosting provider PS.kz (Republic of Kazakhstan), to the corporate email service Google Workspace and to the Telegram messenger, to notify the Operator’s staff of the request; and to public authorities in the cases provided for by the legislation of the Republic of Kazakhstan.

6. Cross-border transfer

Yes. When a request is processed, the data is transferred to Google Workspace and Telegram servers located outside the Republic of Kazakhstan, including in states that may not ensure the protection of personal data. I consent to such cross-border transfer.

7. Dissemination in publicly available sources

No. The Operator and third parties do not disseminate my personal data in publicly available sources.

8. Term of consent

The consent is valid for 12 months from the date the form is sent or, if a contract is concluded on request, for the period needed to perform it and to keep the documents under the legislation of the Republic of Kazakhstan.

9. Withdrawal of consent

I may withdraw my consent by writing to info@shamstudios.kz or to the Operator’s address, except where withdrawal contradicts the laws of the Republic of Kazakhstan or there is an unfulfilled obligation (Article 8(2) of the Law). After withdrawal, the Operator stops processing and destroys the data unless there are other legal grounds for keeping it.

10. Evidence of consent

The date and time of consent, the page language and the version of this text are stored with the request and confirm that consent was received. I have read the Privacy Policy.
